THE SHORT VERSION
- Your rights under the Australian Consumer Law always apply.
- Website builds are a fixed price for the scope in your written quote.
- Hosting and care are billed in advance, and you can cancel any time.
- I work hard to keep sites secure, but no system can be guaranteed 100% secure.
- Domain fees follow the registry’s rules and can’t be refunded once a name is registered.
About these terms
Jenkins Digital is a web design and hosting business in Canberra, run by James Jenkins. In these terms, “I”, “me” and “my” mean Jenkins Digital, and “you” means the person or business using this site or my services.
By using this site or ordering a service, you agree to these terms, my Acceptable use policy and my Privacy policy. If your written quote says something different, the quote applies to that job.
Using this website
You’re welcome to browse, share links and get in touch. Please don’t:
- copy, modify or republish the site’s design, code or content without permission;
- try to break, overload or get unauthorised access to the site or its systems;
- collect other people’s information from the site without their consent;
- use the site or its forms to send spam, malicious code or anything unlawful.
I keep the information here as accurate and current as I can, but prices and features can change, and your written quote is what counts. Links to other websites are there for convenience, and I’m not responsible for their content.
Website design
- Quotes. Every build is quoted in writing, with a fixed price for the scope described. Anything outside that scope is quoted before I start on it.
- Packages. Starter includes up to 5 pages and Business up to 10, and both include 3 months of website hosting. Customised projects are priced to the project.
- Payment. Payment terms, such as any deposit, are set out in your quote.
- Your content. You need the rights to any text, images and logos you supply.
- Ownership. Once your build is paid in full, the website’s design and content are yours. Themes, plugins and other third-party software stay licensed by their makers. Premium plugins I supply under my licences are provided while I host or care for your site; if you move elsewhere, I’ll tell you which ones need a licence of your own.
Website hosting
- Plans. Bronze, Silver and Gold, with the CPU, memory and storage shown on the hosting page.
- Billing. Plans are billed in advance, monthly or yearly, through the Client Hub, and renew automatically until cancelled.
- Cancelling. You can cancel at any time. Your plan stays active until the end of the period you’ve paid for, and part-periods aren’t refunded unless the law requires it.
- Backups. Daily backups are a safety net, not a guarantee. Keep your own copy of anything you can’t afford to lose.
- Availability. I work to keep your site online, but I can’t promise uninterrupted service. Maintenance and problems at upstream providers can cause downtime.
- Resources. If a site consistently needs more than its plan allows, I’ll talk to you about moving to a larger plan.
- Care included. Website care comes with every hosting plan.
- Leaving. You can ask for a copy of your site at any time while your plan is active.
Website care
- What’s included. Speed and image optimisation, an SEO review, security hardening, weekly backups, premium plugins, and up to an hour of content updates each month on request. Fair use applies.
- Access. I’ll need administrator access to your site, and sometimes to your hosting account.
- Your host. Every host is different. If yours has limits that get in the way, I’ll work with you and them to find a solution, but I can’t control their service.
- Billing. $15 a month, billed in advance. You can cancel any time, and care continues to the end of the month you’ve paid for.
Security
- What I do. I take reasonable steps to secure the sites I host and look after, including security plugins, hardening and keeping software up to date, and I work with my upstream providers to keep things secure over time.
- No guarantee. No system is ever completely secure. I can’t guarantee that a site will never be attacked or compromised, and by using my services you accept that risk.
- Sites hosted elsewhere. If your site is hosted with another provider, its security also depends on their servers and service. I can’t control or fix weaknesses in hosting I don’t manage.
- If something happens. If I find or am told about a security problem on a site I look after, I’ll let you know and work with you to fix it.
Domain names
- Registration. I register domains for you through a registrar partner. Each extension has its own registry rules, and .au domains follow the rules set by auDA.
- Eligibility. Registrant details must be accurate. .au domains need an Australian connection, usually an ABN or ACN.
- Fees. Registration is paid in advance for the registration period, and can’t be refunded once the domain is registered.
- Renewals. A domain must be renewed before it expires, or it can be lost to someone else.
- Transfers. You can move your domain to another provider, subject to the registry’s rules.
Payments
Prices are in Australian dollars. Payments for hosting, care and domains are made through the Client Hub and processed by Stripe, so I never see or store your full card number. If a payment fails, I’ll contact you before suspending anything.
Your rights and my liability
My services come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
Where the law allows, if a service isn’t provided properly, my liability is limited to supplying it again or paying the cost of having it supplied again. I’m not liable for indirect losses, such as lost profits or lost data, except where the law says I am.
Suspending or ending a service
I may suspend or end a service if payment is overdue, if a site breaches the Acceptable use policy, or if it puts other sites or systems at risk. Where I can, I’ll contact you first and give you a chance to fix the problem.
General
- I may update these terms from time to time. The date at the top shows the latest version, and changes don’t affect work already quoted.
- These terms are governed by the laws of the Australian Capital Territory.
